2. Information We Collect

Information you provide directly

  • Contact form submissions: Name, email address, phone number, and message content when you use our contact form.
  • Account registration (practitioners): Name, email, credentials, license number, practice details, profile photo, and payment information when you create a practitioner account.
  • Communications: Any information you share when you email or call us.

Information collected automatically

  • Usage data: Pages visited, time on site, links clicked, and search queries made within the directory.
  • Device and browser data: IP address, browser type, operating system, and referring URL.
  • Cookies and similar technologies: See Section 5 for more detail.

Information we do NOT collect

Important

Healing In Color is a directory platform. We do not collect, store, or process any clinical health information, therapy session notes, diagnoses, treatment records, or other Protected Health Information (PHI). All clinical interactions occur directly between clients and independent practitioners.

3. How We Use Your Information

We use the information we collect to:

  • Operate and maintain the Healing In Color directory and website
  • Process practitioner memberships and manage accounts
  • Respond to inquiries submitted through our contact form
  • Send transactional emails (e.g., account confirmations, payment receipts)
  • Improve platform features, search functionality, and user experience
  • Analyze aggregate, anonymized usage data to understand how the platform is used
  • Comply with applicable laws and legal obligations

We do not sell your personal information to third parties. We do not use your data for advertising or marketing purposes without your explicit consent.

4. How We Share Your Information

We may share information in limited circumstances:

  • Service providers: We work with trusted third-party vendors (e.g., payment processors, hosting providers, email platforms) who access data only as needed to perform services on our behalf and are bound by confidentiality obligations.
  • Practitioner profiles: Information you include in your public practitioner profile (name, credentials, specialties, contact details, photo) is visible to site visitors as intended.
  • Legal requirements: We may disclose information if required to do so by law, court order, or to protect the safety of our users or the public.
  • Business transfers: In the event of a merger, acquisition, or sale, user data may be transferred as part of that transaction. We will notify affected users in advance.

5. Cookies & Tracking Technologies

We use cookies and similar technologies to keep you logged in, remember your preferences, and understand how visitors use our site. These include:

  • Essential cookies: Required for core site functionality (e.g., login sessions).
  • Analytics cookies: Help us understand traffic patterns and improve the platform (e.g., Google Analytics). These are anonymized and aggregate.

Practitioner account data is retained for the duration of the membership and for a reasonable period after cancellation for administrative and legal purposes. Contact form submissions are retained for up to 24 months. You may request deletion of your data at any time (see Section 8).

7. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, or misuse. Our site uses HTTPS encryption for all data transmission. Payments are processed through PCI-compliant third-party processors — we do not store full payment card details.

No method of transmission over the internet or electronic storage is 100% secure. While we take data security seriously, we cannot guarantee absolute security. We encourage you to use strong passwords and to report any suspected security issues to us promptly.

8. Your Rights & Choices

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data, subject to certain legal exceptions.
  • Opt-out: Opt out of non-essential communications at any time by contacting us or using unsubscribe links in emails.
  • Data portability: Request a machine-readable copy of data you have provided to us.

Healing In Color is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with information, please contact us and we will promptly delete it.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top and, for material changes, notify registered practitioners by email. We encourage you to review this page periodically.

By accessing or using the Healing In Color website and directory at healingincolor.com ("the Platform"), you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. About Healing In Color

Healing In Color is a curated online directory operated by Healing In Color LLC ("Company," "we," "us," or "our"). We connect individuals seeking mental health and wellness support with independent practitioners who provide culturally responsive care. We are a directory platform — not a healthcare provider. We do not provide therapy, medical advice, diagnoses, or treatment of any kind.

2. Who May Use the Platform

You must be at least 18 years of age to use this Platform. By using Healing In Color, you represent that you meet this requirement. The Platform is intended for use by:

  • Clients: Individuals seeking to locate and connect with culturally responsive wellness and mental health providers.
  • Practitioners: Licensed or qualified wellness professionals who register for a listing on the Platform.

3. Not Medical Advice

Important Medical Disclaimer

Nothing on this Platform constitutes medical, psychiatric, psychological, or therapeutic advice. The directory is provided for informational purposes only. All care is provided exclusively by independent practitioners. Healing In Color LLC is not responsible for any care, treatment, outcomes, or interactions between clients and practitioners found through the directory. If you are experiencing a mental health crisis, please call or text 988 (Suicide & Crisis Lifeline) or go to your nearest emergency room.

4. Practitioner Accounts & Listings

Eligibility

To create a practitioner listing, you must hold valid credentials appropriate to the services you offer and be in good standing with any applicable licensing boards. By registering, you represent that all information provided — including credentials, license numbers, specialties, and contact details — is accurate, current, and complete.

Account responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must promptly update your profile if your credentials, license status, or practice information changes.
  • You must not share your login credentials or allow others to access your account.

Practitioner conduct

Practitioners agree not to use the Platform to engage in any deceptive, misleading, or fraudulent practices; to misrepresent credentials or licensure; or to contact clients for purposes unrelated to their stated professional services.

5. Membership Plans & Payments

Practitioner listings are available through paid membership plans as described on the Membership Plans page. By subscribing:

  • You authorize us to charge the applicable fees to your payment method on the billing schedule you select.
  • All fees are stated in US dollars and are non-refundable except where required by applicable law or expressly stated otherwise.
  • We reserve the right to change pricing with at least 30 days' advance notice to active members.
  • Your listing remains active for the duration of your paid term. We do not guarantee a specific number of client inquiries or profile views.

6. Prohibited Uses

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent information
  • Harass, threaten, or harm any other user
  • Scrape, copy, or reproduce Platform content without written permission
  • Attempt to gain unauthorized access to Platform systems or other accounts
  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Impersonate any person, credential, or organization
  • Interfere with the proper functioning of the Platform

7. Intellectual Property

All content on this Platform — including text, design, graphics, logos, and the Healing In Color brand — is owned by or licensed to Healing In Color LLC and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from Platform content without our express written permission.

Practitioners retain ownership of their own profile content and grant Healing In Color a non-exclusive license to display that content on the Platform for the duration of their membership.

8. Third-Party Links & Providers

The Platform may contain links to practitioner websites and other third-party resources. These are provided for convenience only. Healing In Color does not endorse, control, or assume responsibility for any third-party content, services, or websites. Your interactions with practitioners found through the directory are solely between you and the practitioner.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not verify, endorse, or guarantee the quality, competence, or suitability of any practitioner listed in the directory.

10. Limitation of Liability

To the fullest extent permitted by law, Healing In Color LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including any harm arising from interactions with practitioners found through the directory. Our total liability for any claim shall not exceed the amount paid by you (if any) to Healing In Color in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Healing In Color LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another.

12. Termination

We reserve the right to suspend or terminate your account or access to the Platform at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion. Upon termination, your listing will be removed and you will not be entitled to a refund for any unused portion of a paid term, except as required by law.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered practitioners of material changes by email at least 14 days before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
